Terms of Service

Acceptance of these terms

By using identities.dev (the "Site"), you agree to these Terms of Service. The Site is operated by Silver Dev Studios (an unregistered, non-trademarked project), operated in California, USA. If you do not agree, do not use the Site. Some features require a Discord account; using them also binds you to Discord's Terms of Service and policies.

Clickwrap consent. The Site blocks use until you affirmatively accept these Terms and the Privacy Policy through the consent prompt (clicking "Accept" after confirming you read them). Your acceptance is recorded server-side with the document version id and the date/time of acceptance. When a document changes, the Site prompts you again to accept the new version and — until you do — restricts your use of the Site (including publishing).

Accounts

Your content

You retain whatever ownership rights you have in the content you create — submitting content does not give you ownership of someone else's material, and you must have the rights to anything you publish. By publishing a profile, you grant Silver Dev Studios a non-exclusive, worldwide, royalty-free license to store, host, copy, reproduce, cache, modify solely for technical formatting, distribute, and publicly display that profile as needed to operate, maintain, secure, moderate, back up, and provide the Site — including serving it through the Site's API, rendering thumbnails and previews, and showing it in galleries or listings. This license ends when you delete the profile, except that copies may remain in backups, or where retention is required by law or needed for legitimate operational purposes.

Identity Pro & promotional codes

Identity Pro is an optional premium tier that unlocks additional blocks, templates, and profile features. Access may be granted by redeeming a promotional code ("key") issued by Silver Dev Studios — for example, through giveaways or events in the identities.dev Discord server.

Fees & payment

Identity Pro is currently granted through promotional codes. If we introduce paid subscriptions or one-time purchases in the future, the following applies to any paid features:

Acceptable use

You agree not to publish content that is illegal, abusive, harassing, infringing of others' rights, or otherwise inappropriate. You are responsible for the content you publish and for ensuring you have the rights to any material (including images and audio) you include.

Prohibited content. You may not publish content that contains or promotes:

No malicious content. Your content must not contain malware, phishing links, or scripts designed to harm, disrupt, or exploit the Site, other users, or our third-party infrastructure (such as GitHub or Render).

No scraping or reverse engineering. You may not use bots, scrapers, crawlers, or spiders to extract data from the Site or its APIs in bulk, and you may not probe, overload, or attack the Site's endpoints. Except for the Site's publicly released source code, you may not reverse-engineer, decompile, or copy the platform's underlying infrastructure.

Community rules. Content you publish must also follow the rules posted in the identities.dev Discord server. Those rules largely restate these Terms and the Privacy Policy and ask that you use common sense about what you post. If the community rules ever conflict with these Terms, these Terms control.

No NSFW content. The Site has no age-restricted pages and minors may use it. Do not publish sexually explicit or sexually suggestive content (including sexualized depictions of anyone who is or appears to be a minor), graphic gore or gratuitous violence, or content promoting self-harm or illegal drug use. Content that moderators reasonably consider inappropriate for a general audience that may include minors may be removed even where it is not specifically listed above.

Publishing is public

Published profiles are stored in a private GitHub repository but are served publicly through the Site's API and can be viewed by anyone with the profile URL — including on the Site's community and discovery pages and in profile listings. Do not include sensitive personal information, credentials, or private data in a published profile.

Content moderation & takedown

The Site reviews reports of content believed to be illegal, abusive, harassing, inappropriate, or infringing. The process is:

  1. Reporting. Anyone may report a published profile they believe violates these Terms.
  2. Careful examination. Reports are generally examined before any content-removal action is taken. Content is not removed automatically.
  3. Immediate action when necessary. Notwithstanding the review process above, we may take immediate action — including removing content or suspending access — when reasonably necessary to protect users, the Site, or third-party services (for example, content that is actively delivering malware or attacking infrastructure).
  4. Removal & flagging. If we determine that content violates these Terms, we may remove it and flag the publishing user's account.
  5. Appeals. If you disagree with a removal or a flag, you may appeal by contacting someone in the identities.dev Discord server. A dedicated bot-based appeal system is planned; until it is available, appeals are handled through the Discord server.

We act in good faith and aim to handle reports promptly, but the process is manual and not guaranteed to be instantaneous. We do not guarantee that all prohibited content will be detected, reviewed, or removed.

Copyright complaints. If you believe content on the Site infringes your copyright, send a takedown request to info@identities-dev.com that includes the URL of the infringing profile and proof that you own the copyrighted material. We review valid requests and remove infringing content as appropriate.

Third-party services

The Site uses Discord (authentication), GitHub (storage), and Render (hosting). Your use of these services is also subject to their own terms and policies. We are not responsible for their practices.

No affiliation. identities.dev is an independent third-party service and is not affiliated with, endorsed by, or sponsored by Discord Inc., GitHub, or Render. Discord outages, actions taken against your Discord account (such as bans), and other third-party service changes are outside our control and are not our responsibility.

Discord terms

Features that use Discord (sign-in, publishing under your Discord username, live presence blocks, and the Bot's slash commands) are subject to Discord's applicable terms, policies, and developer requirements, including Discord's Developer Terms of Service and Developer Policy. Detailed descriptions of how we handle Discord data live in the Privacy Policy. You may not use the Site in a way that would violate Discord's terms (for example, misusing presence data to harass or surveil someone).

Age

You must be at least 13 years old to use the Site. Features that use Discord additionally require you to meet the minimum age Discord sets for your country, if higher. The Site is not directed at children under 13 and we do not knowingly collect personal information from them; if we learn that a user is under 13, we will remove their published content and block their access.

No warranty

The Site is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, or that published profiles will remain available indefinitely.

Limitation of liability

To the maximum extent permitted by applicable law, Silver Dev Studios shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site.

Indemnification

You agree to indemnify, defend, and hold harmless Silver Dev Studios from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to content you publish, your use of the Site, or your violation of these Terms — including actions taken against our third-party infrastructure (such as GitHub or Render) resulting from content you publish. Silver Dev Studios retains sole control over the selection of legal counsel and the strategy for defending or settling any third-party claim, and you agree to cooperate with that defense.

Termination

You may stop using the Site at any time. We may suspend or disable access for users who violate these Terms or to protect the service. Termination may result in the unpublishing or deletion of your profiles, username/profile URLs, and associated data — subject to our Privacy Policy, legal obligations, backups, and legitimate operational needs — and ends any Identity Pro access.

Governing law & disputes

These Terms are governed by the laws of California, USA, without regard to conflict-of-law principles. We will first try to resolve any dispute informally through the identities.dev Discord server. If that is not possible, disputes shall be brought in the courts of California, USA.

Changes to these terms

We may update these Terms. When we do, the version id and "Effective" date above change, the prior text stays readable from the version history below, and the Site prompts you to accept the new version; your acceptance is recorded with its version id and timestamp. A new version becomes effective for you when you affirmatively accept it through the Site's consent mechanism. If you access or use the Site without accepting the new version — for example by bypassing the interface block — that use itself constitutes binding acceptance of the current version.

No waiver

If we do not enforce a provision of these Terms in a particular instance, that does not waive our right to enforce it later or in other situations.

Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full effect.

Entire agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and Silver Dev Studios regarding the Site. The rules posted in the identities.dev Discord server and any feature-specific rules are incorporated by reference, but if they conflict with these Terms, these Terms control. Changes to these Terms require the consent process described in "Changes to these terms" — editing a Discord server rule does not amend these Terms.
